Terms of Service

These Terms of Service ("Agreement", "Terms", "TOS") govern the relationship between ITPYX ("Company", "we", "us", or "our") and the individual or entity ("Client", "Customer", "you", or "your") who purchases or uses any of our services, including but not limited to web hosting, WordPress hosting, reseller hosting, VPS hosting, cloud hosting, domain registrations, email services, automation hosting (n8n), and any other related services (collectively, the "Services").

By purchasing, accessing, or using our Services, you agree to be bound by this Agreement, our Acceptable Use Policy (AUP), and any other applicable policies. If you do not agree, you must discontinue use immediately.

1. Service Activation and Payments

1.1 Services will only be activated after payment verification. 1.2 Clients are responsible for ensuring that payments are made on or before the due date. 1.3 Renewal invoices are generated in advance. If payment is not received within the stated grace period, the service will be suspended and/or terminated as detailed below. 1.4 All services must be used strictly within the limits of the specifications listed in the relevant hosting or service plan. No additional privileges, resources, or benefits beyond those stated will be provided.

2. Hosting Services (Web, WordPress, Reseller, VPS, Cloud)

2.1 Service activation is subject to successful payment verification. 2.2 The specifications and resources included in each plan are fixed. Downgrades or upgrades are only possible by purchasing a different plan. 2.3 If renewal payment is not received within 7 days of the due date, the account will be suspended. 2.4 If renewal payment is still not received within 14 days of the due date, the account will be permanently deleted, and all data will be irretrievably lost. The Company will not be responsible for data recovery under any circumstances. 2.5 Any violation of these Terms or the Acceptable Use Policy may result in suspension or termination without notice.

3. Domain Registration & Renewal

3.1 Domain registrations will be activated only after payment verification. 3.2 Domains must be renewed on or before the due date. If payment is not received, the domain will enter a grace period starting the following day. 3.3 Domains in the grace period may be unlocked by paying a redemption fee of PKR 30,000 (or equivalent in your billing currency). 3.4 If the Client does not redeem the domain, it may be released to the public registry and become available for public registration. The Company assumes no responsibility for domain loss after expiration.

4. Email Services

4.1 Bulk email marketing through our email servers is strictly prohibited without prior written approval. 4.2 Any attempt to send bulk emails without authorization will result in immediate suspension of the email service, as such activities may cause IP/server blacklisting. 4.3 Phishing, spamming, fraud, or any illegal activities through the email service are strictly prohibited and will result in immediate suspension or termination without notice. 4.4 The Client is solely responsible for all email activity conducted through their account.

5. Automation & n8n Hosting

5.1 Service activation is subject to payment verification. 5.2 Renewal invoices will be issued before the due date. If payment is not received within 15 days, the account will be permanently deleted without suspension or grace period. 5.3 Once deleted, no data recovery is possible. Clients are responsible for maintaining backups of their workflows and data.

6. Acceptable Use Policy (AUP)

6.1 Clients may not use our services for: • Fraudulent activities • Illegal websites or operations (including pornography where prohibited by law, gambling without license, etc.) • Phishing, scamming, impersonation, or identity theft • Hosting pirated content, copyrighted material without permission, or pirating software • Counterfeiting products, selling fake goods, or brand impersonation • Hosting websites that promote violence, hate speech, terrorism, or illegal substances • Any other illegal activity under local or international law 6.2 If the Company detects violations of the above: • In cases of fraud, phishing, piracy, or illegal activities, services will be suspended immediately without notice. • In cases of counterfeiting or impersonation, the Client will be given a 3-day notice to either remove the content or provide verifiable proof that no impersonation is taking place. Failure to comply will result in suspension.

7. Service Modifications and Updates

7.1 The Company reserves the right to modify service pricing, specifications, and policies at any time without prior notice. 7.2 In the event of major changes, Clients will be notified via email or client portal announcements. 7.3 The Company reserves the right to change DNS records or configurations when necessary for security, compliance, or service maintenance, and will notify Clients after such changes.

8. Uptime, Maintenance & Support

8.1 The Company will take reasonable measures to maintain service uptime. 8.2 Scheduled maintenance or updates may cause temporary downtime, for which Clients will be notified in advance when possible. 8.3 The Company will not be liable for any damages or losses caused by downtime, maintenance, or unexpected outages.

9. Data Responsibility

9.1 Clients are fully responsible for maintaining their own backups. 9.2 The Company is not obligated to recover or restore deleted, lost, or corrupted data after suspension, termination, or service deletion. 9.3 Clients agree to implement their own backup strategies if data preservation is critical to their operations.

10. Termination of Services

10.1 The Company may suspend or terminate any service without notice if: • The Client violates these Terms or the Acceptable Use Policy • The Client engages in fraudulent, illegal, or harmful activities • Payment is not made within the specified timeframe • Continued use of the service may harm the Company's infrastructure, reputation, or other customers 10.2 Upon termination, all data associated with the service may be deleted permanently without liability.

11. Limitation of Liability

11.1 The Company provides all services on an "as-is" and "as-available" basis. 11.2 The Company makes no warranties or guarantees regarding uptime, speed, or availability beyond what is reasonably expected in the industry. 11.3 The Company shall not be held liable for: • Data loss, downtime, or interruptions • Financial losses, damages, or legal issues caused by Client misuse of services • Issues arising from third-party providers, registries, or external services

12. Governing Law

12.1 These Terms shall be governed and construed in accordance with the laws of Pakistan. 12.2 Any disputes arising from or related to this Agreement shall be subject to the exclusive jurisdiction of the courts located in Lahore, Pakistan.

13. Acceptance

By purchasing or using any of our Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service.
